DECLARACIÓN PÚBLICA DE SIETE OBJETORES DE CONCIENCIA DE BOGOTA

El pasado mes de enero 7 miembros de la Acción Colectiva de Objetores y Objetoras de Conciencia - ACOOC - se declararon objetores y objetoras de conciencia ante la Dirección de Reclutamiento del Ejército nacional, la Personería de Bogotá, la Oficina de la Alta Comisionada de las Naciones Unidas para los Derechos Humanos, Defensoría del Pueblo, Procuraduría General de la Nación, la Vicepresidencia de la República y el Ministerio de Defensa. En sus declaraciones Álvaro Peña, Milena Romero, Carlos Gutiérrez, Daniel Rodríguez, Estefanía Gómez, Julián Ovalle e Ingrid Zapata plantearon su negativa a participar y colaborar con cualquier grupo armado por razones de conciencia, basados en el antimilitarismo y la NoViolencia Activa. La declaratoria se presentó junto con el carné de objetor, y cartas de apoyo de la IRG y de ACOOC.

A pesar de nuestros argumentos y los desarrollos a nivel internacional, las respuestas de las autoridades están orientas hacia la obligación del cumplimiento de la legislación actual con respecto al servicio militar Obligatorio. A continuación, compartimos con ustedes algunas de las respuestas entregadas por estos organismos.

DIRECCIÓN NACIONAL DE RECLUTAMIENTO

De acuerdo a la ley 48 de 1993 vigente para este momento en su artículo 3º refiere el SERVICIO MILITAR ES OBLIGATORIO: Todos los colombianos están obligados a tomar las armas cuando las necesidades públicas lo exijan, para defender la independencia nacional y las instituciones públicas, con las prerrogativas y las exenciones que establece la presente Ley... De acuerdo a lo anterior y con base en el principio de igualdad usted debe inscribirse en cualquier distrito militar... para definir su situación militar de acuerdo a las normas preexistentes.[1]

Ahora bien, frente a lo que manifiesta... con respecto a la Acción Colectiva de Objetores y Objetoras de Conciencia, es importante precisar que el llamamiento realizado a los varones a prestar el servicio militar obligatorio se encuentra desarrollado no sólo en el postulado según el cual el interés general prima sobre el particular, en concordancia con el mandato Constitucional, donde el servicio militar vincula a todos los varones por dos razones: en el plano de los deberes, por la imperiosa necesidad de que que de él se tiene para la efectiva defensa de la patria y en los derechos, por elemental aplicación del principio de igualdad, sino que además se encuentra legalmente establecido en la Ley 48 de 1993 y Decreto Reglamentario 2048 de 1993, caso contrario sucede respecto a la figura de objeción de conciencia, que a pesar de esta`r contemplada en el artículo 18 de la Carta Política en la actualidad no ha sido institucionalizada en el régimen relacionado con el servicio militar, por cuando no resulta propio de las exigencia del servicio militar el autorizar a los ciudadanos para no atender este deber esencial. Conforme a las Sentencia T-409/92 y C-511/94 de la Corte Constitucional.[2][3]

...de conformidad con el Artículo 33 del Código Contencioso Administrativo, se envió por competencia a la Dirección de Reclutamiento y Control Reservas del Ejército Nacional, para su conocimiento y acciones pertinentes...[4]

DEFENSORÍA DEL PUEBLO

Atentamente señalamos que recibimos su comunicación relacionada con nuestra intervención a fin de proteger sus derechos por cuanto usted se declara objetor de conciencia... le indicamos que por razones de competencia se allegó su escrito al director de reclutamiento y control reservas, en donde solicitamos dar respuesta a su petición de acuerdo a los términos legales.[5] La obligación de prestar el servicio militar es desarrollo del postulado según el cual los intereses colectivos prevalecen sobre los individuales, la objeción de conciencia para que pueda invocarse, requiere de su expresa institucionalización dentro del respectivo ordenamiento jurídico. El servicio militar es una forma de responsabilidad social, que mantiene la conexidad entre la sociedad civil y el Estado, al permitir que los miembros de aquella roten por el poder público armado que éste ejerce. Es una apertura al ciudadano, antes que una limitación de su libertad. [6] Se afirma la necesidad del servicio militar por su función social, incluso, si llegare a existir objeción de conciencia condicionada a que sea admitida por la legislación del respectivo país, de todas maneras debe establecerse otro servicio análogo, aunque bajo otra modalidad, pero el sentido del servicio en sí, es inobjetable. Así se ha pronunciado la Honorable Corte Constitucional en reiteradas oportunidades.[7]

... No dude en acudir a la Defensoría del Pueblo cuando considere que sus derechos fundamentales son vulnerados, o se sienta discriminada a causa de sus creencias...[8]

PERSONERÍA DEL PUEBLO

... manifiesta su íntima convicción antimilitarista la cual le impide participar en acciones militares o armadas... esta declaratoria fue enviada para conocimiento de la Procuraduría General de la Nación...[9]

COMENTARIOS GENERALES

COMO LO MENCIONAMOS ANTERIORMENTE LAS RESPUESTAS ESTÁN DIRIGIDAS A RECORDAR LA OBLIGACIÓN DE LA PRESTACIÓN DEL SERVICIO MILITAR, EN EL MARCO DEL CUMPLIMIENTO DE LOS DEBERES CONSTITUCIONALES. CADA UNA DE LAS AUTORIDADES DEL ESTADO SE EXONERAN DE CUALQUIER RESPONSABILIDAD BAJO EL AMPARO DE LA REGLAMENTACIÓN DE LA LEY 48 DE 1993, LA CUAL NO CONTEMPLA LA FIGURA DE OBJECIÓN DE CONCIENCIA. ASÍ MISMO, NO HAY UNA LECTURA DE LOS DESARROLLOS Y PRONUNCIAMIENTOS QUE HA HECHO NACIONES UNIDAS AL RESPECTO.

ESTA PRIMERA ACCIÒN DIRECTA JURÍDICO-POLÍTICA, ESTARÀ ACOMPAÑADA DE UNA SEGUNDA, EN LA CUAL OTROS CINCO OBJETORES Y OBJETORAS DE BOGOTÀ SE DECLARARÁN ANTE AUTORIDFADES, PERO ESTA VEZ EXIGIENDO PRONUNCIAMIENTOS CONCRETOS SOBRE LOS PACTOS INTERNACIONALES QUE COLOMBIA A SUSCRITO Y LOS PRIMERO SIETE ESTUDIARÁN LOS ARGUMENTOS PARA ENVIAR NUEVAMENTE LAS DECLARACIONES PUBLICAS CON LOS NUEVOS ARGUMENTOS.

PUBLIC DECLARATION OF SEVEN COUNCIENTIOUS OBJECTOR FROM BOGOTA

Last January, 7 members of the Acción Colectiva de Objetores y Objetoras de Conciencia - ACOOC - declared themselves as conscientious objectors before the Department of Recruitment of the National Army, Personería de Bogotá, Office of the High Commissioner for Human Rights, Ombusmand’s office, General Attorney, Vice President of the Republic and Minister of Defense. In their declaration, Alvaro Peña, Milena Romero, Carlos Gutierrez, Daniel Rodriguez, Estefanía Gómez, Julián Ovalle and Ingrid Zapata expressed their negation to participate and collaborate with any armed group because of reasons of conscience, based in antimilitarism and active nonviolence. The declaration was presented with conscientious objector identity card and support letters from War Resisters International and ACOOC.

Despite our arguments and developments at the international level, the responses of the authorities remain oriented towards complying with the present legislation in regards to obligatory military service. Therefore, we would like to share with you all some of the responses presented by these national and international bodies:

NACIONAL OFFICE OF RECRUITMENT

In accordance of the 48th law of the 1993 in its third article signed out that MILITARY SERVICE IS OBLIGATORY: all Colombians are obligated to take up arms when public needs requires, in order to defend national independence and public institutions, with the prerogatives and exceptions that establish the present law... In accordance to the previous statement and based on principals of equality, you should inscribe yourself in any of the military branches... in order to define your military situation in accordance to the pre-existing norms[1].

Now, in front of what is declared... About the Acción Colectiva de Objetores y Objetoras de Conciencia (translated: Collective Action of Conscientious Objectors) it is important to specify that the actual call for men to fulfill their obligatory military service is found to be developed not only in the postúlate, in which the common interest is over the individual one, in accordance with the constitutional mandate where military service is linked to all men for two reasons: at the level of obligations, because of the pressing need that one has for the effective defense of the homeland and the rights of the people, for the elemental application of the principles of equality, but it is established by law 49 of 1993 and its order in council 2048 of 1993. It does not happened with the case of Conscientious objection that in spite of being contemplated in the Constitution, in the present time it has not being regulated in the military system so, it is not our mandate to authorize citizens not attending this essential duties, according with Constitutional Court’s sentences T-409/92 and C-511/94. [2]

MINISTRY OF DEFENSE

...conforming to the 33rd article of the Contentious Administrative Code, your declaration was sent to the Department of Recruitment and Reserve Control of the National Army for their knowledge and pertinent action[3].

OMBUSMAND’S OFFICE

We cautiously acknowledge that we have received your communication in relation to our intervention in order to protect your rights when you declare yourself as a conscientious objector. We wish to indicate to you that for reasons of competition gathered through your declaration to the Director of Recruitment and Reserve Control, wherein we wished to answer your petition in accordance to legal terms...[4] The obligation to fulfill military service is developed from the assumption that the collective interests prevail over those of an individual, invoking conscientious objection requires your expressed institutionalization within the respective judicial orders. Military service is an aspect of social responsibility that maintains the connection between civil society and the State to permit those members of that one to move through the armed public power that it exert. [5] This is an opening up of your ability to exercise your citizenship where there was previously a limitation of your liberty. We affirm the necessity of military service for one’s social function, which is to say that if conditional conscientious objection was to be admitted into the legislation of a respective country, an analogous fulfillment of service should be established under another modality, but that the sense of the service is unobjectionable. This has been therefore pronounced repeatedly by the Honorable Constitutional Court. [6]

Do not hesitate to turn to the Defense of the Public when one considers that their fundamental rights are vulnerable, or one feels discriminated against because of their beliefs. [7]

PERSONERÍA DEL PUEBLO

...Declare their intimate antimilitaristic conviction, which impedes them from participating in military or armed actions... this declaration was sent to the General Attorney for recognition. [8]

GENERAL COMMENTS

AS WE PREVIOUSLY MENTIONED THESE RESPONSES ARE MEANT TO SERVE AS A REMINDER OF THE OBLIGATION OF FULFILLMENT OF MILITARY SERVICE IN ORDER TO COMPLY WITH CONSTITUTIONAL REQUIREMENTS. EVERY ONE OF THE STATE AUTHORITIES ARE EXONERATED FROM ANY AND ALL RESPONSIBILITIES UNDER THE PROTECTION OF THE REGELATIONS OF THE 1993 LAW 48, THAT WHICH DOES NOT FIGURE IN CONSCIENTIOUS OBJECTION. ALSO, THERE IS A COMPLETE LACK FOR READING THE DEVELOPMENTS AND THE PRONOUNCEMENTS OF THE UNITED NATIONS IN THIS RESPECT.

THIS FIRST JUDICIAL-POLITICAL DIRECT ACTION WILL BE ACOMPANIED BY A SECOND IN WHICH FIVE CONSCIENTIOUS OBJECTORS FROM BOGOTA WILL DECLARE THEMSELVES BEFORE THE AUTHORITIES, DEMANDING CONCRETE PRONOUNCEMENT IN REGARDS TO THE INTERNATIONAL PACTS TO WHICH COLOMBIA HAS SUBSCRIBED AND THE FIRST SEVEN WILL STUDY THE ARGUMENTS IN ORDER TO SEND AGAIN THE PUBLIC DECLARATIONS WITH THE NEW ARGUMENTS.
